1. Introduction & Acceptance

These Terms & Conditions ("Terms") govern your access to and use of the website hydropulseindia.com (the "Website") and your purchase of HydroPulse electronic water conditioners and related products and services from Mizusun Pvt. Ltd. ("Mizusun", "HydroPulse", "we", "us", "our").

By accessing the Website, placing an order, or using any of our services, you ("you", "user", "customer") agree to be bound by these Terms, our Privacy Policy, and our Cookie & Security Policy. If you do not agree, please do not use the Website or purchase our products.

These Terms constitute a legally binding electronic agreement under the Information Technology Act, 2000 and the Indian Contract Act, 1872, and do not require a physical signature.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under Indian law to purchase from us. By placing an order, you confirm that you meet these requirements and that all information you provide is true, accurate, and complete.

3. About Our Products

HydroPulse is a range of electronic water conditioners using patented Hydro-Polarization Technology, manufactured by Mizusun Pvt. Ltd. Our product range includes:

• Marlin 1.0 — domestic use, pipes up to 1.0 inch (from ₹35,000/-)
• Marlin Pro — larger homes and light commercial, pipes up to 1.5 inch
• HydroPulse Industrial — 2-inch and larger pipes (custom pricing)
• Custom Agricultural Units — sized by flow rate for irrigation systems

3.1 Important Product Disclosures

By purchasing, you acknowledge and understand that:

• HydroPulse is a scale-prevention and pipe-protection device, not a water purifier.
• HydroPulse does NOT reduce TDS (Total Dissolved Solids) and does NOT make water safe to drink.
• HydroPulse is not a replacement for an RO system. For drinking-water purification, an RO or equivalent purifier is still required.
• HydroPulse does not add any chemical, salt, or substance to the water.
• Results such as scale dissolution occur gradually over weeks to months, and outcomes may vary depending on water hardness, pipe condition, flow rate, and installation.
• For heavily encrusted pipes or boilers, an initial chemical clean may be advisable before installation.

We make reasonable efforts to ensure product descriptions, images, specifications, and pricing on the Website are accurate. However, minor variations in appearance, packaging, or specification may occur, and we reserve the right to correct any errors.

4. Orders & Order Acceptance

• Placing an order constitutes an offer to purchase. A contract is formed only when we confirm and accept your order (e.g., by order confirmation email/message or dispatch).
• We reserve the right to accept or reject any order at our discretion, including in cases of suspected fraud, pricing errors, unavailability of stock, or incomplete information.
• If we cancel an accepted order for reasons attributable to us, any amount paid will be refunded in full.

5. Pricing & Payment

• All prices are listed in Indian Rupees (₹) and, unless stated otherwise, are inclusive of applicable taxes (GST). Industrial and agricultural units are subject to custom quotation.
• Prices are subject to change without prior notice, but changes will not affect orders we have already accepted.
• In the event of an obvious pricing or typographical error, we reserve the right to cancel the affected order and refund any amount paid.
• Payments are processed securely through our payment gateway partner, Razorpay, which supports UPI, credit cards, debit cards, net banking, and EMI options.
• We do not store your full card or banking credentials. Payment processing is subject to Razorpay's terms and security standards.
• You represent that any payment instrument used is lawfully yours.

6. Shipping & Delivery

• We offer PAN-India shipping. Estimated dispatch is typically 1–2 business days, with transit time generally 3–7 business days, subject to location and courier availability.
• Delivery timelines are estimates and not guaranteed. Delays may occur due to courier issues, weather, regional restrictions, or other factors beyond our control.
• Risk of loss and title pass to you upon delivery to the address you provide. Please ensure the delivery address is accurate; we are not responsible for failed delivery due to incorrect addresses.
• You should inspect the package upon delivery and report any visible transit damage promptly (see Section 8).

7. Warranty

• HydroPulse products carry a 2-year warranty from the date of delivery against manufacturing defects, covering parts and workmanship as specified in the applicable warranty terms.
• The warranty does not cover damage caused by misuse, unauthorised repair or modification, power surges, water ingress beyond the rated IP protection, physical/accidental damage, or normal wear and tear.
• To claim warranty service, contact us with your order details and proof of purchase. We may repair, replace, or otherwise remedy a valid claim at our discretion.
• This warranty is in addition to, and does not limit, any rights you may have under the Consumer Protection Act, 2019.

8. Returns, Cancellations & Refunds

8.1 Return Window

We offer a 10-day return policy for eligible domestic purchases. You may request a return within 10 days from the date of delivery if you are not satisfied, provided the product is:

• Unused or used only for testing, in resaleable condition;
• Returned with all original packaging, accessories, and documentation; and
• Accompanied by valid proof of purchase.

8.2 Non-Returnable Items

Custom-configured Industrial and Agricultural units, and products damaged by misuse, may not be eligible for return.

8.3 Order Cancellation

You may cancel an order before dispatch by contacting us promptly. Once dispatched, the return process applies.

8.4 Refunds

• Approved refunds are processed to the original payment method via Razorpay.
• Refunds are typically initiated within 7 business days of receiving and inspecting the returned product; the time for the amount to reflect depends on your bank/payment provider.
• Shipping or handling charges (if any) may be non-refundable, except where the return is due to our error or a defective product.

8.5 Damaged or Defective on Arrival

If a product arrives damaged or defective, notify us within 48 hours of delivery with photos/evidence. We will arrange a replacement or refund at no extra cost to you.

9. Intellectual Property

All content on the Website — including the HydroPulse name, logo, "Hydro-Polarization Technology", product designs, text, graphics, images, videos, case studies, and software — is the property of Mizusun Pvt. Ltd. or its licensors and is protected by applicable intellectual property laws, including any registered patents and trademarks.

You may not copy, reproduce, distribute, modify, republish, or create derivative works from any content without our prior written permission. Limited use for personal, non-commercial reference is permitted.

10. Acceptable Use

You agree not to:

• Use the Website for any unlawful, fraudulent, or harmful purpose;
• Attempt to gain unauthorised access to our systems, accounts, or data;
• Introduce viruses, malware, or any malicious code;
• Scrape, harvest, or misuse data or content from the Website;
• Post false reviews, impersonate others, or submit misleading information;
• Interfere with the proper functioning or security of the Website.

We reserve the right to suspend or terminate access for any breach of these Terms.

11. User Content (Reviews & Testimonials)

If you submit reviews, testimonials, photos, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content for marketing and informational purposes. You confirm the content is truthful, your own, and does not infringe any third-party rights. We reserve the right to moderate or remove user content at our discretion.

12. Disclaimers & Limitation of Liability

• The Website and products are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim implied warranties not expressly stated herein.
• Product outcomes depend on individual water conditions and usage; we do not guarantee specific results beyond the product specifications and described function.
• To the maximum extent permitted by applicable law, our total liability arising out of or relating to any product or your use of the Website shall not exceed the amount you paid for the relevant product.
• We are not liable for indirect, incidental, special, or consequential damages, or for delays/failures caused by events beyond our reasonable control (force majeure).
• Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under the Consumer Protection Act, 2019, or other applicable Indian law.

13. Indemnity

You agree to indemnify and hold harmless Mizusun Pvt. Ltd., its directors, employees, and partners from any claims, losses, liabilities, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website or products, or your violation of any law or third-party right.

14. Third-Party Services

The Website integrates third-party services such as Razorpay (payments), courier partners (logistics), and analytics/communication tools. Your use of these services may be subject to their own terms. We are not responsible for the acts, omissions, or content of third parties.

15. Termination

We may suspend or terminate your access to the Website at any time, without notice, for breach of these Terms or for legal, security, or operational reasons. Provisions relating to intellectual property, liability, indemnity, and governing law survive termination.

We aim to acknowledge complaints within 48 hours and resolve them within the period prescribed by law (generally within 30 days).

17. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Subject to applicable consumer-protection law, any disputes shall be subject to the exclusive jurisdiction of the competent courts at Sangli / Kolhapur, Maharashtra, India.

18. Changes to These Terms

We may revise these Terms from time to time. The "Last Updated" date indicates the latest version. Continued use of the Website or purchase of products after changes constitutes acceptance of the revised Terms.
